“MASTERFOODS PROFESSIONAL 1 MILLION POINT GIVEAWAY” PROMOTION
TERMS AND CONDITIONS

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. The Promoter is Mars Australia Pty Ltd (ABN 48 008 454 313) of 1 Petcare Place, Wodonga VIC 3689 (“Promoter”).

  3. Entry is only open to hospitality venues located and operating in Australia who are registered Countrywide Food Service Distributors (“Countrywide”) “InSeason Rewards Program” customers (“Eligible Business”).
  4. Membership of Countrywide Food Service Distributors “InSeason Rewards Program” (and consequently participation in this competition) is subject to terms and conditions which apply to Inseason Rewards program members available at                                                     (https://www.whatsinseason.com.au/about/terms-and-conditions and https://www.whatsinseason.com.au/about/terms-of-use as amended from time to time. 

  5. Employees (and their immediate families) of the PromoterCountrywide Food Service Distributors, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

  6. From the start of the Promotional Period, in addition to entry into the promotional draw, an Eligible Business may also earn bonus Award Points in their InSeasons Rewards program by completing a Qualifying Transaction (“Double Points Offer”). Eligible products and the rates and terms and conditions on which Award Points are earned on eligible products are described in the Countrywide online product catalogue on the InSeason Rewards Site (https://www.whatsinseason.com.au/) from time to time and are subject to change. Award Points for the Double Points Offer are earned at a rate of 2 Award Points per A$1 (excluding GST) paid by an Eligible Business as a registered customer for purchases of eligible products through a Registered Distributor Account. The Eligible Business’ Inseason Rewards Account will be automatically credited with the InSeason Rewards points on the 20th of the following month of purchase.   7. Entries into the promotion open on 01/07/2024 and close at 11:59pm AEST 31/07/2024 (“Promotional Period”).

  8. To be eligible to enter and receive an automatic entry into the draw, an authorised person on behalf of an Eligible Business, must purchase, one or more jars of MasterfoodsTM Professional Gluten-Free Whole Egg Mayonnaise 2.2kg (“Participating Product”) from Countrywide Food Service Distributors during the Promotional Period (“Qualifying Transaction”). 

  9. Entries will be automatically recorded via the Countrywide Food Service Distributors database connected to the Eligible Businesses’ InSeason Rewards Program Account. Multiple entries permitted. For every Participating Product purchased in one Qualifying Transaction or across multiple Qualifying Transactions, an Eligible Business will gain one (1) entry. For example, if an Eligible Business purchases five (5) Participating Products, in accordance with the entry instructions, the Eligible Business will be awarded five (5) entries into the draw. 

  10. The Promoter reserves the right, at any time, to verify the validity of an Eligible Business and their entries and reserves the right, in its sole discretion, to disqualify any Eligible Business who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  11. Eligible Businesses can only enter this promotion using their individual Countrywide Food Service Distributors “InSeason Rewards Program” Account. If there is a dispute as to the identity or validity of an Eligible Business, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Business.

  12. Incomplete purchases, including without limitation refunded products will be deemed invalid.

  13. This is a game of chance and skill plays no part in the determination of the winning Eligible Businesses. The random draw will take place at Anisimoff Legal, 3 Amy Close, Wyong, NSW 2259 on 30/08/24 at 2:00pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winning Eligible Businesses will be notified in writing by email within seven (7) days of the draw and the name of the winning Eligible Businesses (and their Postcode) will be published online at  https://www.masterfoodsprofessional.com.au/promotions/inseason-promo on 04/09/2024.

  14. The Promoter’s decision is final and no correspondence will be entered into.

  15. There are four (4) prizes to be won. The first four (4) valid entries drawn from the entries received during the Promotional Period will each win 250,000 Countrywide InSeason Rewards Points valued at up to AUD $2,500 (incl. GST). Only one (1) prize is permitted per Eligible Business (excluding Eligible Businesses in SA). Points are redeemable through the Countrywide InSeason Rewards Program for a maximum of 1 year from the award date, and are subject to the Countrywide InSeason Rewards Program Terms and Conditions available at https://www.whatsinseason.com.au/about/terms-and-conditions. The value of the points awarded has been based on a sample of the items that could be obtained by redeeming the points through the Countrywide InSeason Rewards Program at the time of this promotion. The value of the points will vary depending on how and when they are redeemed by the winning Eligible Business through the Countrywide InSeason Rewards Program.

  16. Prizes will be credited to the winning Eligible Businesses Countrywide InSeason Rewards Program account within 28 days of verification of the winners’ account and entry. 

  17. Subject to the unclaimed prize draw clause, if for any reason a winning Eligible Business does not redeem the prize by the time stipulated by the Promoter and after having made all reasonable attempts to contact the winning Eligible Business, then the prize will be forfeited.

  18. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  19. Total prize pool value is up to AUD $10,000 (incl. GST). Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

  20. A draw for any unclaimed prizes may take place on 30/09/2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winning Eligible Businesses (if any) will be notified in writing within seven (7) days of the draw and the name of the winning Eligible Businesses (and their Postcode) will be published online at https://www.masterfoodsprofessional.com.au/promotions  on 02/10/2024.

  21. Authorised persons on behalf of an Eligible Business consent to the Promoter using their name, likeness, image and/or voice in the event they are a winning Eligible Business (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Business; or (f) use of a prize.

  25. Countrywide collects personal information ("PI") in order to conduct and administer the promotion and may, for these purposes, disclose such PI to the Promoter, third parties,including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Countrywide and the Promoter will also use and handle PI in accordance with the Australian Privacy Principles, the Privacy Act 1988 (Cth) and as set out in each their respective Privacy Policies, which can be viewed at https://www.whatsinseason.com.au/about/privacy-policy andwww.mars.com/privacy.  The privacy policies also contains information about how, authorised persons on behalf of an Eligible Business, may access, update or correct their PI, how an authorised person on behalf of an Eligible Business may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
