TERMS AND CONDITIONS
Information on how to claim and the reward(s) form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions.
Claims are only open to hospitality venues located and operating in Australia (“Eligible Business”).
Employees (and their immediate families) of the Promoter, Participating Distributors and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The offer commences at 12.01am AEST on 01/09/2024 and final claims close at 11:59pm AEST on 30/09/2024 or once $100,000 in claims has been received, whichever is first, (“Offer Period”).
To be eligible to receive a cash back reward of a $50 Digital Prepaid Mastercard®, an Eligible Business must purchase, in a single order, two (2) different Eligible Products from the “Mix” list as detailed below (and on the promotional material) and three (3) different Eligible Products from the “Match” list as detailed below (and on the promotional material) (each an “Eligible Product”) through an eligible foodservice distributor (“Participating Distributor”) during the Offer Period (“Qualifying Transaction”). An Eligible Business must then visit https://www.masterfoodsprofessional.com.au/promotions/mix-n-match-promo, locate the online claim form, input the requested details including full name, email address, phone number and foodservice distributor invoice number, consent to marketing and submit the fully completed claim form online during the Offer Period.
Subject to the maximum total gift pool to be redeemed of $100,000, each valid claim received during the Offer Period will be awarded a $50 Digital Prepaid Mastercard®. Eligible Businesses should allow up to fourteen (14) business days for their transaction to be validated and reward sent.
The Digital Prepaid Mastercard® is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 pursuant to license by Mastercard. T&Cs apply. Mastercard and the circles design are registered trademarks of Mastercard International Incorporated. Redemption of the Digital Prepaid Mastercard is subject to the standard terms and conditions, which can be found at https://thecardnetwork.com.au/pages/terms-conditions. Any ancillary costs associated with redeeming a Digital Prepaid Mastercard are not included. Any unused balance of a Digital Prepaid Mastercard will not be awarded as cash.Redemption of a Digital Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Digital Prepaid Mastercard.
Multiple claims permitted, subject to the following: (a) only one (1) claim per Qualifying Transaction; and (b) a maximum of two (2) claims permitted per Eligible Business during the Offer Period.
If, during the Offer Period and until a reward is awarded, any Eligible Products contributing towards a Qualifying Transaction are returned for a refund or credit, or exchanged for a product or products that are not Eligible Products, the Promoter reserves the right in its absolute discretion to invalidate any claims in respect of that Qualifying Transaction (or reduce the number of rewards awarded accordingly).
The Promoter reserves the right, at any time, to verify the validity of claims and Eligible Businesses and reserves the right, in its sole discretion, to disqualify any Eligible Business who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete and indecipherable claims will be deemed invalid.
If there is a dispute as to the identity of an Eligible Business or authorised representative, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Business or authorised representative.
The Promoter’s decision is final and no correspondence will be entered into.
If for any reason an Eligible Business does not take/redeem their reward at/by the time stipulated by the Promoter, then reward will be forfeited.
If any reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the reward with a reward to the equal value and/or specification.
Subject to clause 7, the total amount in rewards available to be claimed is up to $100,000.
Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) use / taking of the a reward.
The Promoter may collect personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and reward suppliers. Participation in this offer is conditional on providing this PI. PI will be stored on the Promoter's database. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its Privacy Policy which is located at www.mars.com/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business or the individuals who are the subject of the PI. The Privacy Policy also contains information about how the individuals who are the subject of the PI may opt out, access, update or correct their PI, how these individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose PI collected as part of this offer to any entity outside of Australia.
